Part I
The Preliminary Clauses

  1. These General Terms and Conditions (hereinafter referred to as "Terms and Conditions" or "GTC") govern the rights and obligations related to the purchase of online professional workout videos (hereinafter referred to as "Services") on the website www.suzn.life and are an integral part of the contract concluded between the Seller (the provider of online workout videos on the website www.suzn.life) and the Buyer.

  2. By completing the order form at www.suzn.life, the Buyer declares that he/she has read these GTC and that he/she agrees with them.

  3. These GTC are available on the website www.suzn.life and are valid and applicable from the date of publication.
Part II
Definitions of terms
  1. The Seller /Provider/, Supplier of Services is a company SUZN,s.r.o., with its registered office at Partizánska cesta 30, 974 01 Banská Bystrica.
  2. The Buyer (User) is any visitor to the Website who orders the Services via electronic forms of communication at www.suzn.life.
  3. The service means access to: a) online professional exercise videos or b) 1 selected single exercise video - published on www.suzn.life, which are considered as electronic content.
  4. Order means an order form filled in by the Buyer with the selected Service and entering the login details on the www.suzn.life website. The Order is the Purchase Contract on the basis of which the sale of the Services is made. These GTC are an integral part of the Purchase Agreement.
  5. Purchase Price means the purchase price for the Service.
  6. The login data are e-mail and the password created to it as part of the unique user access. The password is entered by the Buyer in the registration form as part of the ordering process.
Part III
Information for the Buyer before the contract is concluded
  1. The subject of the contract is the delivery of digital content, which will not be delivered on a tangible medium, therefore the Buyer expressly and explicitly agrees that this content will be delivered before the expiration of the statutory cancellation period.
  2. For cancellation, the Buyer may not terminate a contract whose subject matter is digital content (access to online workout videos) unless it has been delivered on a tangible medium and has been delivered with the prior explicit consent of the Buyer before the expiration of the cancellation period.
Part IV
Process of conclusion of the Purchase Agreement
  1. The order becomes obligatory for the Buyer upon its completion and sending in accordance with point 2. of this Part.
  2. The Buyer's procedure for creating an Order is as follows:
    1. The Buyer selects the Service by clicking on the "Purchase Access" icon in the Videos section directly on the video preview or in the Price List section, where the Buyer also selects the required access option.
    2. Next, the Buyer fills in the Contact details in the following range:
      - the name and surname of the buyer,
      - email,
      - country
      - source of information about the site
      - newsletter option
      - password setting and password confirmation
    3. If the buyer wishes to enter company details, he/she shall enter it in the order form in the following range: company ID number, VAT number, registered office or place of business. Company details can only be entered with the first order.
    4. If the Buyer wishes to purchase access as a gift or apply a discount code, the Buyer shall select the required field in the Order Form.
    5. And at the same time the Buyer is required, after reading the General Terms and Conditions and the Privacy Policy, to select this box as a sign of agreement with its contents. After selecting the "Next" button, the Buyer will be taken to the summary of the Order.
    6. If the Buyer agrees to the price for the Service, the General Terms and Conditions and the Privacy Policy, by clicking on the "Confirm and proceed to payment" button, the order becomes mandatory. With this action, the Order is submitted.
  3. The Buyer will be sent an automatically generated e-mail with a summary of the order after the Order has been sent with the obligation to pay in accordance with point 2. of this section. The Buyer will then be redirected to pay via the inline payment gateway Go Pay.
  4. The Purchase Contract is signed at the moment of delivery of the automatically generated e-mail with the Order information. The automatically generated e-mail contains a summary of the details of the concluded Purchase Contract (Order).

  5. By confirming and sending the payment (payment by bank card) through the GoPay payment gateway for the Service to the account of SUZN,s.r.o., the Buyer will gain immediate access to the paid Services and an invoice for the paid Service will be sent to the Buyer's e-mail. By successfully sending the payment, the Buyer is entitled to use the paid Services on the www.suzn.life website within the range of the Buyer's order.

  6. The Buyer is obliged to enter and fill in the relevant text lines with true and complete data. The Buyer also understands that the Seller will consider the data entered by him to be correct and complete and is not entitled to check the data entered.

  7. The offer of services via the www.suzn.life website in the Slovak version is limited to the Slovak and Czech Republics. Through the English version of the suzn.life website it is possible to purchase services from all over the world. The services are offered to individuals - non-business persons and individuals - entrepreneurs and also to companies.
  8. The Buyer accepts that access to the online workout videos may not be available continuously, especially with regard to necessary maintenance of the Seller's hardware and software equipment or third party hardware and software equipment.

  9. The Buyer also agrees that in the event of a breach of the commitments arising from the contractual relationship with the Seller (as the Service Provider), including these General Terms and Conditions, the Seller is entitled to terminate the contract with the Buyer and restrict the Buyer's access to the online workout videos. Especially, the Seller is entitled to restrict access in case the User interferes in any unauthorized way with the copyrights or makes his/her access (login) data available to third parties.

  10. Buyer understands that the online workout videos at www.suzn.life are optimized for the latest versions of desktop and mobile operating systems and Seller is not responsible for any technical issues caused by older versions of software and hardware.
  11. The Seller is entitled to contact the Buyer by e-mail.
Part V
Access to online videos and payment methods

The buyer can choose one of the accesses to the online workout videos:
1. Pay for access to one selected single workout video for 24 hours from the time of purchase. Single payment is possible via the Go Pay payment gateway.

2. Pay for recurring access to all workout videos on a monthly, quarterly or half yearly basis. This is an automatic recurring payment that is made through the Go Pay payment gateway.

Part VI
Copyright
  1. The Buyer understands that the online workout videos on the suzn.life website are works in the meaning of the Copyright Act (Act No. 185/2015 Coll., as amended) and as such are under protection of this Act.
  2. The conclusion of the Purchase Agreement grants online access for a limited period of time, as specified in the description of the individual Services, for the Buyer's personal use. In connection with the access, the Buyer understands that he may only dispose of it in accordance with copyright law, in particular he is not entitled to copy, store on media, distribute, sell or otherwise provide the online workout videos to third parties.
  3. The Buyer further acknowledges that when using the services (copyright works), the Buyer is obliged to respect and comply with the applicable legislation, in special the Copyright Act, and is obliged to refrain from any interference with copyright and intellectual property rights.
  4. The Buyer acknowledges that he/she may be prosecuted for infringement of copyright or other rights protected by law under valid legislation.
Part VII
Claims
  1. Due to the nature of subject of the Contract, the Buyer is obliged to note that the web-based online workout video system is optimized for the latest browser versions and requires standard hardware. Therefore, no claim can be made if the malfunction is caused by insufficient technical equipment of the user.
  2. Purchased services on the website www.suzn.life can be claimed only in connection with their web unavailability, the inability to play the purchased online workout videos, unless the technical problem, which is not related to the maintenance of software and hardware, arose on the part of the Seller. In the event of a complaint, the Buyer shall send an e-mail message to the Seller describing the content of the complaint. Complaints shall be handled immediately, but no later than within 30 days the Buyer shall receive an opinion on the Complaint in the form of an e-mail.
Part VIII
Use of services
  1. The Provider hereby grants the Buyer a non-exclusive, time-limited license to use the online workout videos in the way defined in these Terms and Conditions.
  2. The Seller has the right to restrict access to or interrupt the functionality of the www.suzn.life website for a period of time strictly necessary for maintenance or repair of the website or any other reason on the side of the Seller or a third party.
  3. The Buyer is obliged to comply with the applicable legislation of the Slovak Republic and the European Union when using the services. The Buyer is obliged to fully compensate the Seller or third parties for any damages incurred in this way.
  4. In the case of a violation of these Terms and Conditions, the Purchase Agreement or applicable law, the Seller has the right to cancel the Buyer's access to the online videos.
  5. The Purchaser may cancel his/her recurring access to the online workout videos at www.suzn.life at any time by selecting the "Cancel Subscription" option. On this basis, his/her recurring payment and thus access will be terminated. Cancellation of a recurring payment will terminate access on the last day of the period already paid. Cancellation of the account will terminate the Purchase Agreement. In the case of cancellation of a recurring payment, there is no right to a refund of the amount already paid for the Services.
Part IX
Final Clauses

The Terms and Conditions as well as the Purchase Contract and the legal relations arising from it are governed by the law of the Slovak Republic, in particular the Civil Code. Any disputes shall be resolved by mutual agreement of the parties as a matter of priority.

Part X
Validity of the Terms and Conditions
  1. These terms and conditions are valid from 1.3.2021.

  2. The Seller is entitled to unilaterally change the Terms and Conditions. The change shall be notified to the Buyer via the website www.suzn.life in a visible place or by e-mail. By continuing to use the Services, the Buyer agrees to the new version. In case of disagreement, the Buyer has the right to reject the changes to the Terms and Conditions within 10 days of first logging into his User Account after notification of the change to the Terms and Conditions or from receiving an e-mail message notifying of the change and to terminate the Agreement (cancel the recurring payment - subscription in his profile) within the 10-day notice period. The termination notice shall be delivered to the Seller by e-mail: info@suzn.life.
